Terms of service
Overview
Welcome to SwimStars Swimming (“SwimStars”, “we”, “us”, “our”). We operate this website and store (the “Services”) to offer digital publications and related content. Our store is powered by Shopify, which enables the Services, but purchases are made with SwimStars (see “Relationship with Shopify”). By using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.
1. Access and Account
You confirm you are 18+ (or the age of majority in your jurisdiction) and that any minors using the Services do so with your permission. You are responsible for your account and keeping credentials secure. Information you provide must be accurate and current.
2. Our Digital Products
We sell digital publications (e.g., PDF eBooks). Display quality (colour, layout) can vary by device. Descriptions may change without notice; we may limit availability by person or region.
Licence: Upon purchase, we grant you a personal, non-exclusive, non-transferable licence to download and use the eBook for private, non-commercial use. You may not share, resell, redistribute, upload, or otherwise make our files available to others.
System requirements: You’ll need a compatible device and PDF reader; your internet connection and device security are your responsibility.
Download access: We may provide link-limited or time-limited download access and may apply reasonable download limits to prevent abuse.
3. Orders & Cancellations for Digital Content
When you place an order, you make an offer to buy. We accept once payment is processed and access is provided.
Cooling-off for digital downloads: Under UK law, if you choose immediate access/download, you expressly consent to immediate supply and acknowledge you lose your 14-day cancellation right once the download or streaming starts. We will present this acknowledgement at checkout.
Faulty digital content: If a file is faulty, we will repair or replace it within a reasonable time; if that’s not possible, we’ll provide a price reduction/refund as appropriate. This does not affect your statutory rights and may include compensation for damage to your device caused by our failure to use reasonable care and skill.
4. Prices, Taxes & Billing
Prices shown apply at the time of order. Unless stated otherwise, prices are inclusive of VAT where applicable. Note: UK e-books are generally zero-rated for VAT (audiobooks excluded), but you remain responsible for any taxes outside the UK.
You agree to provide accurate billing details and authorise charges to your selected payment method.
5. Digital Delivery & Access
There is no physical shipping. After purchase and acceptance, we provide download access or delivery via email link. Delivery times can depend on payment clearance, fraud checks, and third-party platform uptime. You’re responsible for safekeeping your files (we don’t provide ongoing cloud backup).
6. Intellectual Property
All content in our Services—including eBooks, text, graphics, images, video, logos, and layout—is owned by SwimStars or our licensors and protected by UK and international copyright and database rights. Except for the limited licence in Section 2, no rights are granted. Do not copy, distribute, modify, or make derivative works without our written permission.
7. Optional Tools
We may offer integrations or tools from third parties (e.g., file delivery, analytics). They are provided “as is” without warranties, and your use is at your discretion and subject to those providers’ terms.
8. Third-Party Links & Affiliate Relationships
The Services may link to third-party sites. Purchases made off-site are between you and the third party; we are not responsible for those products, services, or policies. Review their terms and privacy notices before transacting.
9. Affiliate Links (Amazon Disclosure)
We sometimes use affiliate links. As an Amazon Associate, we earn from qualifying purchases. Pricing/availability on Amazon or other sites is determined by those third parties. We don’t control or fulfil those orders.
10. Class Bookings via ClassForKids
Booking and payment for swim classes are handled on ClassForKids (or another third-party booking system). Those bookings are governed by the booking platform’s and the class provider’s terms (including payment schedules, cancellations, and refunds). Please refer to: ClassforKids Terms. SwimStars is not the merchant of record for those bookings and is not responsible for platform outages, payment processing, or class-provider policies.
11. Relationship with Shopify
SwimStars is powered by Shopify, which enables our storefront and checkout. Your purchase contract is with SwimStars, not Shopify. Shopify is not responsible for our sales or products and is released from claims related to your transactions with us.
12. Privacy
Your use of the Services is subject to our Privacy Policy. Because we are hosted by Shopify, certain personal data is processed by Shopify to operate and improve the Services; see Shopify’s Privacy Policy as referenced in ours. Our Privacy Policy also explains cookies/affiliate tracking used for link attribution.
13. Feedback & Reviews
If you submit feedback or reviews, you grant us a worldwide, royalty-free licence to use and display them in connection with the Services. You confirm you own or have rights to what you post and that it complies with these Terms.
14. Errors, Inaccuracies & Omissions
We may correct errors or update information (including pricing and availability) at any time without notice.
15. Prohibited Uses
You agree not to misuse the Services, including by infringing IP rights, sharing paid files publicly, introducing malware, scraping, or attempting to circumvent security or download limits.
16. Termination
We may suspend or terminate access if you breach these Terms. Sections intended to survive termination will continue to apply.
17. Disclaimer of Warranties
Except as required by law, the Services and digital products are provided “as is” and “as available.” We do not warrant uninterrupted, timely, or error-free operation.
18. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect or consequential losses (e.g., lost profits, data). Nothing in these Terms limits liability that cannot be limited under law.
19. Indemnification
You agree to indemnify us for losses arising from your breach of these Terms or misuse of the Services.
20. Severability
If any provision is unenforceable, the remainder remains in effect.
21. Waiver; Entire Agreement
No waiver is implied by a failure to enforce. These Terms and policies referenced form the entire agreement between you and us.
22. Assignment
You may not assign these Terms without our consent. We may assign them without notice.
23. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers may have additional rights in their country of residence.
24. Changes to These Terms
We may update these Terms by posting a new version. Material changes will be notified as required by law. Continued use after the effective date constitutes acceptance.
